GDPR information obligation

In accordance with Article 13 paragraphs 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU.L.2016.119.1) (hereinafter “GDPR”), we inform you of the following

  2. Purpose of personal data processing:
    Your personal data will be processed for the purpose of concluding and performing the contract.
  3. The legal basis for processing your data is:
    1. art. 6 sec. 1 letter. b) GDPR – processing is necessary for the performance of a contract to which you are a party or to take action at your request before entering into a contract
    2. art. 6 sec. 1 letter a) GDPR – based on consent
    3. art. 6 sec. 1 letter f) GDPR – processing is necessary for the purposes resulting from the legitimate interests pursued by the ADO.
    4. art. 6 sec. 1 letter c) GDPR – processing is necessary to fulfill a legal obligation incumbent on the ADO.
    5. Provisions of the Civil Code Act and the provisions of the relevant implementing acts.
  4. Providing your personal data is necessary for the performance of the contract.
  5. Your data may be made available to entities authorized under the law and entities to which the ADO has entrusted data in order to properly perform their duties for the purpose and to the extent necessary for these activities.
  6. Processing period:
    The period of processing your personal data depends on the purpose for which the data is processed. The period for which your personal data will be stored is calculated based on the following criteria: the duration of the contract, the legal provisions that may oblige the ADO to process data for a specified period (e.g. a 5-year archiving obligation concerning documents stored for tax purposes) the period that is necessary to defend the interests of the ADO.
  7. You are entitled to:
    • the right to access your data and receive a copy of it,
    • the right to rectify (correct) your data,
    • the right to delete personal data, in a situation where the data is not processed in order to fulfill an obligation resulting from a legal provision,
    • the right to limit the processing of data,
    • the right to object to the processing of data, due to your special situation, in cases where we process your data based on our legally justified interest
  8. The scope of each of these rights and the situations in which they can be exercised result from the provisions of the GDPR.
  9. You may exercise these rights by submitting a request to the Administrator.
  10. You have the right to lodge a complaint with the President of the Personal Data Protection Office if you consider that the processing of your personal data violates the provisions of the GDPR.
